Traffic Violations Bureau
The New York State Traffic Violations Bureau (TVB) is an administrative agency that is part of the DMV and was created to be the court that handles New York traffic tickets issued in certain parts of the state.
The TVB handles traffic tickets issued in:
- The five boroughs of New York City
- The cities of Buffalo and Rochester
- Portions of the towns of Babylon, Brookhaven, Huntington, Islip, Riverhead and Smithtown in Suffolk County
The most significant things to note about the TVB are:
- It is not a true court. It is an administrative agency. The procedure, evidence and other elements of a case in a true court of law don’t always exist in the TVB.
- The police officer who issued the ticket prosecutes his own case. There is no District Attorney to ask the officer questions and assist the People with their case.
- There is no plea bargaining. We cannot ask the court to reduce the charge or ask if we can pay the fine but get no points. If you contest a ticket you will have a hearing and either win (not guilty, no points, no fine) or lose (guilty, points if applicable and fine).
- Judges have discretion with regard to the 11 point suspension threshold. A TVB judge has the discretion to suspend prior to 11 points but also has the discretion to waive a suspension when a motorist surpasses 11 points.
